TTFF ignores Warner and attacks High Court Judge
… Justice Rampersad asked to leave W/Cup bonus case
By LASANA LIBURD (Wired868.com)

Under the threat of incarceration, Trinidad and Tobago Football Federation (TTFF) General Secretary Richard Groden has refused to sue Works Minister and ex-FIFA Vice President Jack Warner and will instead attempt to cross swords with High Court Judge Devindra Rampersad.

Groden and former TTFF President Oliver Camps were required to respond in writing by 31 May 2012 to an application for contempt proceedings by legal representatives of 13 former Trinidad and Tobago international footballers who participated at the Germany 2006 World Cup.

The contempt charge was brought after Camps and Groden repeatedly fail to file a civil suit against Warner, who acted as the TTFF’s Special Advisor during the FIFA tournament, negotiated the bonus payment scheme with the players and, according to the TTFF, banked all the World Cup-related revenue.

However, Wired868 was reliably informed that, rather than respond to the contempt charge, Groden’s attorney, Derek Ali, submitted an application asking Justice Rampersad to disqualify himself from all further rulings on this case for bias.

Hardly cause for excitement... Lasana engaging in a bit of sensationalism.  The players' attorneys have pegged it correctly, nothing but a time-wasting effort.

I think the key fact here is that Groden had no time to respond to the contempt charge, yet employed his lawyer to drum up these accusations. Truth is, what defence could Groden offer for the contempt? The moneys missing, they say Jack has it, they haven't taken action to retrieve it. Game over.

I'm not sure they have realised that if they go to jail for contempt, the case will continue and the next step is seizing their assests. They may choose to stay in jail as that could be the only home they have left!

Except that that time wasting has been an effective tactic for them so far. Rampersad giving these fellas all the rope they can ask for but  no hanging in sight. Especially dangerous with "fast approaching" stautory limits as Rampersad himself apparently described it. That was some 6 months ago.

Could also be they are trying to stir up emotion to force mistakes from the bench.

But the paranoid schizophrenic in my head telling me this judge may acquiesce/capitulate/roll over and play dead in some form because he is not interested in bringing harm to Warner in any way.

Statutory limits only apply to filing the claim, not resolving the matter... so the dilatory efforts by the TTFF won't affect the resolution of the case, it will only serve (they hope) to frustrate and unsettle the plaintiffs, and perhaps distract the judge at the same time.

I with you dey, but ah think the judge himself made note of the time limits some time ago.  Now I'm wondering why he would have done that..... ??? :-\

Thanks for that info. The TTFF playing some desperate hands. Makes you wonder just how heavy the stakes really are.

Judge Rampersad, which law school did you go to and what are they really teaching you in there? Do they actually have more spineless judges like you presiding in court rooms all over Trinidad and Tobago? The frigging spineless idiots in the ttff just called you out. If you need some balls go ask Shabbazz. Now the spotlight is on you. Quick Monty, do something.

Not at all.

People getting too tie up in this legal wrangling, and as I said before, Lasana's choice of words only serves to inflame and confuse the situation. The TTFF not 'attacking' the judge at all. This judge will have to be a real ass (which isn't beyond the pale) to take any of this personal.  Motions to recuse are fairly routine under circumstances like these.  At the next Bar event all ah dem go be sipping scotch and coconut water together like nutten happen.

That is the one aspect of this that most people all over the world doesn't realize.  In many instances judges and lawyers all socialize together and know each other well.  They might even engage in a small talk about a case in common where the judge could even tell the lawyer "smart move dey" or "dey in rell trouble" all while laughin dey ass off

Exactly... at the end of the day all ah dem still have to work together (perhaps Townley excepted).  The legal fraternity is small and will remain so. Not to suggest that everyone in cahoots, but most know to keep their disagreements on a professional level. In this case there is nothing that the TTFF is alleging about the judge to make him react, beyond rolling he eyes and saying tuh heself:  "dai'z de best allyuh could come up with? steups".
